Company Terms and Conditions

Definitions

  1. In these terms of trade “Company” means Patchwork Electrical.

  2. The “Customer” means the purchaser of goods & services or any person acting on behalf of and with the written authority of the Customer.

  3. “Works” means all Works, supply or materials, advice or recommendations.

  4. “Materials” means Materials required to complete the Works.

  5. “Estimate Cost” means the cost of carrying out Works for which, after making all reasonable inquiries cannot provide a definitive price.

  6. “Price” means the Price of the Works as agreed jointly with the Company & Customer.

General

  1. The Customer shall make available to the Company personnel use of adequate site amenities at no cost to the Company.

  2. The Customer shall inform the Company personnel of;

  • Specific safety requirements pertaining to the site.

  • Any incident or potential hazard that may cause harm to the Company personnel. 

   3. The Company personnel shall have free & unrestricted access to all required work areas.

   4. The Company personnel shall present in Company uniform whilst working on site.

Installation Work

  1. All installation Work will comply with the Australian Standards at the time of the Work.

  2. Where Work is to extend or modify existing circuits, costs quoted assume that the existing installation is in adequate working condition and complies with minimum current regulations. This not being the case, the Customer will be notified and any Work the Company is required to do to bring the necessary parts of the existing installation up to the standard will incur additional cost.

  3. Where practical to do so, cables will be concealed in cavities, building voids, under floors, ceiling spaces etc. Where impractical to do so, cables will be neatly surface run, either clipping direct or housed in trunking or conduit.

  4. Any entry holes in plaster work necessary for cable access will be filled, however the final surface plaster finish & paint is excluded.

  5. All endeavours will be made to ensure that the area in which the installation Work has been carried out will be left in a tidy & clean condition.

Price

  1. Unless agreed upon in writing, payment in full must be made on the completion of the Works.

  2. The Company reserves the right to request payment for any goods & services prior to commencement of Work.

  3. The Company reserves the right to request stage payments where the planned Work takes longer than 7 days.

  4. If full payment for goods and services is not made to the Company at the completion of the Work or the stage payment agreed upon, the Customer shall be in default and the Customer shall at the Company’s discretion (and without affecting any other right the Company may have), pay a default interest of 5% per month on any amount outstanding to the Company.

  5. The Customer shall also be liable to pay all expenses and costs (including legal costs as between solicitor and client) in relation to the Company obtaining or attempting to obtain remedy for the failure to pay.

  6. During the term of which the Customer is in default on any account with the Company, the Company may suspend or withhold the provision of goods and services.

Acceptance

  1. Any instructions received by the Company from the Customer for the supply of Work and/or the Customer’s acceptance of the Work undertaken by the Company shall constitute acceptance of the terms and conditions contained herein.

  2. If the Customer requests suspension or cancellation of the agreed Work, the Company may increase the agreed price to cover any resulting extra expense.

  3. None of the Company’s agents or representatives are authorised to make any representations, statements, conditions or agreements not expressed by the Company owner in writing nor is the Company bound by any such unauthorised statements.

Goods and Risk

  1. Ownership of goods supplied shall remain with the Company until payment in full has been received for them.

  2. The Customer is responsible for ensuring that the goods are insured for the duration of the installation Work.

  3. The Company shall have the right at any time after payment is due, and not made, to enter premises occupied by the Customer and take possession of the goods. The Customer indemnifies the Company for all costs and expenses incurred in effecting repossession and removal of the goods.

  4. If the Customer shall cease trading, be placed in receivership or liquidation, become bankrupt or permit the Customers good to be taken in execution, or compound or make an arrangement with the Customers creditors then, in addition to, and without prejudice to, any other rights or remedies the Company might have, the following shall occur:

  • All unpaid accounts in respect to the goods and services supplied by the Company shall become immediately due and payable, and

  • The provisions relating to the Company’s right of entry, repossession and recovery of goods shall apply.

Warranty

  1. Patchwork Electrical warrants its installation work to be defect free for a period of twelve months from invoice date. Such cover does not extend to goods not supplied by Patchwork Electrical, physical damage to products, or any instance where the original installation has been altered or tampered with subsequently by third parties.

Limitation of Liability

  1. The Company’s liability for any loss, damage or expense arising out of the goods and services provided is limited at the Company’s option, to either:

  • Replacing or repairing any part of the work which the Customer is entitled to reject; or

  • Refunding the price of the Work which the Customer is entitled to reject.

 

   2. In any event, the Company will not be liable for any claim unless the claim is notified to the Company within:

  • 12 months of the completion of the Work; and

  • 7 days of the alleged defect becoming apparent; and

  • The Company is given a reasonable opportunity to investigate the claim.

Dispute Resolution

In the event of a dispute, mediation is to be the preferred method of resolution.
